Therefore, support policies for e-commerce should be integrated into national target programs to ensure sustainability and coherence.Responding to the comments, Deputy Minister Tan affirmed that in addition to policies, implementation measures and supporting resources are essential. For cooperatives, collective economies, and ethnic communities, legal provisions must be concrete and feasible. Specialized agencies should consider integrating e-commerce development into national programs, from infrastructure and platforms to online sales assistance, while recognizing successful models, combining traditional markets and digital commerce, to create new consumption channels for agricultural and specialty products.Representatives from the General Department of Taxation under the Ministry of Finance also contributed significant input. They proposed extending the minimum data retention period for goods and service information posted on e-commerce platforms from 12 months to at least 24 months, in line with Decree 53/2022/ND-CP guiding the Law on Cybersecurity, thereby facilitating tax management of e-commerce and livestream sales activities.<figure class="image"><img src="https://img-ven.congthuong.vn/resize/th/upload/2025/10/07/anh-4-16334001.jpg" alt="A representative from the General Department of Taxation under the Ministry of Finance shares insights during the session."></figure>A representative from the General Department of Taxation under the Ministry of Finance shares insights during the session.Regarding Article 44 on e-commerce databases, the General Department of Taxation suggested clarifying the MoIT’s responsibilities in three aspects, issuing data connection standards among ministries; developing technical infrastructure for information sharing; and establishing mechanisms for inter-ministerial data exchange.On taxation policy, the agency supported studying appropriate incentives to foster e-commerce development but emphasized that these incentives must be integrated into existing tax legislation such as the Law on Value-Added Tax and the Law on Corporate Income Tax. It noted that tax revenues from e-commerce this year have increased by 50–60 percent, partly due to back-tax collection from previous years.At the meeting, the representative of the Ministry of Science and Technology proposed broadening the definition of “electronic contract data” to include certificates, documents, and related information generated before and after signing, ensuring data integrity and evidentiary value.Other recommendations included adding prohibitions aligned with related laws, extending the data retention period beyond 24 months to fit e-transaction characteristics, and revising overlapping or inconsistent provisions. They also called for clear regulations on licensing amendments, violation handling, and transitional clauses to enhance coherence and feasibility.Promoting sustainable e-commerce developmentDuring the discussion, the representative of the Vietnam Trade Promotion Agency under the MoIT suggested the drafting team further specify several key elements in the draft law.Provisions defining “large digital platforms” (Articles 3, 16, 17, 18, 31) currently lack quantitative criteria. Without clear thresholds, enforcement could be difficult, particularly in monitoring obligations and platform accountability. The agency recommended referencing benchmarks in other legislation, such as the Law on Electronic Transactions or the Law on Consumer Protection, like user-base thresholds (e.g., around three million users) to ensure consistency.Regarding Article 39 on “green e-commerce,” the agency noted that the draft fails to connect with national or international standards on sustainability, risking inconsistent self-defined “green” criteria across platforms. It proposed reviewing the draft to align management and trade promotion in the digital environment with existing laws on trade promotion, advertising, and sales stimulation, avoiding overlapping authority while encouraging sustainable e-commerce development.A representative from the MoIT’s Legal Department emphasized that the draft law must accurately reflect the nature of relationships in this sector, distinguishing those between service providers and consumers from those between service providers and regulatory bodies. Many current banking applications offer e-commerce services such as movie or lottery ticket sales without clear legal oversight, the department noted.It also pointed out that cross-border services under international agreements do not fully cover e-commerce in the narrow sense. Treating e-commerce merely as a conventional cross-border service could create disparities in tax and legal obligations. The law must uphold fairness, comply with the Constitution and international commitments, and protect domestic enterprises’ interests during integration and implementation.Concluding the session, Deputy Minister Nguyen Sinh Nhat Tan affirmed that the feedback received was vital for enhancing the draft law’s feasibility and alignment with international commitments. Transparent communication is essential to build trust and ensure that customers, particularly large industrial users, can manage their energy consumption effectively under the new system.Nguyen Anh Tuan’s presentation highlighted the EVN’s efforts to develop a scientifically grounded and practical framework for the two-part tariff. The proposed mechanism includes a clear methodology for calculating capacity and energy charges, tailored to the technical and operational requirements of different customer groups.&nbsp;The EVN’s initial focus on large industrial consumers reflects a strategic decision to pilot the tariff with users who have the technical capacity to adapt, such as those already participating in direct power purchase agreements. This phased approach allows the power sector to refine the system before expanding it to other customer segments, such as commercial or smaller industrial users.Minister Dien, in his concluding remarks, emphasized the consensus among stakeholders on the urgent need to implement the two-part tariff by January 1, 2026, starting with large-scale consumers. He commended the EVN and ministry units for their proactive efforts in developing the framework and preparing the necessary infrastructure. To ensure a successful rollout, the Minister outlined five critical tasks:1. The Electricity Regulatory Authority, in coordination with the EVN, must refine the two-part tariff proposal scientifically, incorporating global best practices, and submit it to ministry leadership and relevant authorities by October 15, 2025, accompanied by a comprehensive impact assessment.2. The Authority, alongside the EVN, will review and propose amendments to decision no. 14/2025/QĐ-TTg on retail tariff structures, ensuring compliance with current laws and practical implementation. Simultaneously, circular 16 must be revised to establish pricing guidelines, with EVN leading the development of a transparent cost-calculation methodology.3. The EVN will advise the government (or the Minister) on selecting eligible customer groups, develop transparent operational software by October 20, 2025, and adhere to the electricity Law, resolution 70, and upcoming decrees. Initially, the tariff will apply to large consumers, with dual billing (current and two-part tariffs) until December 31 to facilitate customer adjustment.4. The EVN must engage consultants to build transparent management software by October 20, 2025.5. From September 15, a comprehensive communication plan will be developed, highlighting the electricity law, resolution 70, the draft government resolution, and regional/international tariff comparisons. Initial implementation will target large consumers, with future expansions ensuring fairness through peak and off-peak pricing.“We cannot afford to hesitate. This is the collective will of the energy sector. With a robust political and legal foundation, our task now is to act decisively,” Minister Dien declared. He urged media outlets to partner with the MoIT in disseminating accurate information about the two-part tariff, emphasizing its necessity and benefits to help customers adapt to the new pricing structure.International experience demonstrates that two-part tariffs are widely adopted across the region and globally, encouraging efficient electricity use, optimizing load factors, and reducing the need for costly grid expansions. The dual goals of economic progress and environmental protection demand new capabilities and an adaptive workforce, Investments in education and reskilling will need to expand, with current R&amp;D spending at just 0.2 percent of GDP, there is need for a major push. Public-private partnerships and international collaboration will be key to move to this new growth model.With a net-zero target by 2050 and its role in the Just Energy Transition Partnership, Viet Nam is stepping up. But transitions can be disruptive. Policies must ensure that green jobs are accessible, retraining is available, and vulnerable communities are supported. This is not just about economic growth with environmental sustainability, it is also about social justice. And specifically so, given an ageing population.Capable responsive institutions, especially at the local level, are essential for delivering quality public services. Viet Nam's shift to a two-tier government structure offers both opportunities and challenges. Proximity to communities enables reach and a deeper understanding of citizen needs, but it also places greater responsibility on the capabilities of local authorities.
